An arbitrator with the National Arbitration Forum has awarded KinectGamesStore.com domain name to Microsoft.Microsoft was represented by Molly Buck Richard in this case . All started when Microsoft submitted a complaint to the National Arbitration Forum,asserting legal rights over the disputed domain name.


The company provided the Panel with evidence of its registration of the "Kinect" mark with the Hong Kong Trade Mark Registry .Therefore,they contended in the complaint that the disputed domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the disputed domain name in bad faith .
"Complainant alleges that Respondent used the disputed domain name and resolving website to post links to various third-party websites, most of which compete with Complainant.  Respondent’s posting of hyperlinks to Complainant’s competitors negatively affects Complainant’s business because Internet users looking for and intending to find Complainant’s products may instead purchase similar products from Complainant’s competitors as a result of Respondent’s use of a confusingly similar domain name. "


The Panel ordered the disputed domain name be transferred from the respondent to the complainant.
